Terms and Conditions — Mattress Mart Direct
Terms and Conditions
Last updated: 27 July 2026
This website exists to explain what we sell and to let you book a free fitting. It does not sell anything. These terms cover using the site, booking an appointment, and what our published information does and does not promise.
1. Agreement
By using this website you agree to these terms. If you do not agree, please do not use it.
2. This site does not sell anything
You cannot buy a mattress, a lift chair or a recliner through this website, and nothing on it is an offer to sell. Everything we sell is sold in person at 926 S Arizona Ave, Butte, Montana, after a fitting. Booking a Comfort Fitting creates no obligation on you to buy and no obligation on us to sell any particular item.
3. Comfort Fitting appointments
- Fittings are free and carry no obligation.
- An appointment request is a request. It is confirmed when we contact you and agree a time.
- Please tell us if you cannot make it, so we can give the slot to someone else.
- We may need to reschedule occasionally. If we do, we will contact you.
- Any written recommendation we give you reflects what we had available and what we measured on the day. It is not a quotation that binds us indefinitely, and prices and availability can change.
4. Prices and product information
- Mattress prices shown on this site are our retail prices at the time of publication and may change without notice.
- Comparison figures described as suggested retail are the manufacturer’s own published figures, not ours. We do not control them and they may change.
- Cost-per-night figures are arithmetic across the stated warranty period. They are a way of comparing prices, not a prediction of how long a product will last.
- Seating is not priced on this website. Chair prices depend on the size and configuration that fits you and are given in person.
- Specifications, dimensions, capacities, materials and finishes are supplied by the manufacturer and can change without notice. Colours shown on a screen are approximate.
- We try hard to keep this site accurate. If something is listed at an obviously incorrect price or with an obviously incorrect specification, we are not obliged to honour it.
5. Warranties
Product warranties are given by the manufacturer, not by us. Where this site describes warranty terms, those are the manufacturer’s published terms as we understand them at the time of writing, summarised for convenience. The manufacturer’s own warranty document governs, and it is the document to rely on.
Warranty terms differ between products and, for seating, between American-built and imported models. Manufacturers commonly exclude damage from misuse, unauthorised repair, and exceeding a product’s stated weight capacity. We will tell you which terms apply to the specific item you are considering, before you buy it.
6. Medical devices and health information
Power lift recliners are classified by the U.S. Food and Drug Administration as Class II medical devices intended to assist persons with chronic physical disablements. That is a regulatory classification of the device. It is not a claim that any product will treat, cure or improve any condition.
Where this site describes heat, massage or positioning features, those descriptions are the manufacturer’s, including the manufacturer’s own qualifying language, and we repeat them as such. Nothing on this website is medical advice. Talk to your doctor or therapist about what is suitable for you.
7. Medicare
Medicare Part B may cover part of the cost of the seat lift mechanism only — never the chair itself — where it is medically necessary, prescribed by your physician, and the required documentation is completed. Coverage depends on your plan, your physician’s documentation, and the supplier’s enrolment status. It is not available in a skilled nursing facility, hospice or nursing home.
We cannot promise what Medicare will approve, and nothing on this site should be read as a guarantee of coverage or reimbursement.
8. Orders, cancellation and returns
9. Delivery
10. Text messages
If you give consent on our booking page, we may text you about your appointment, and separately about offers if you asked for those too. Consent is not a condition of purchase, it is never pre-ticked, and you can reply STOP at any time. Full detail is in our Privacy Policy.
11. Our content
The text, layout, design and original photography on this site belong to us. Manufacturer product photography, trade names and trademarks — including Spring Air, Dura-Last, Qube, UltraComfort and UltraCozy — belong to their respective owners and are used to identify the products we sell. Please do not copy our content for commercial use without asking.
12. Third-party links
Where we link out, for example to a manufacturer’s published pricing, we do not control that site and are not responsible for its content.
13. Limitation of liability
This website is provided as-is. To the fullest extent the law allows, we are not liable for indirect or consequential loss arising from use of the site or reliance on information published on it. Nothing in these terms limits any liability that cannot lawfully be limited, and nothing here affects your statutory rights.
14. Governing law
These terms are governed by the laws of the State of Montana, and any dispute will be handled in the courts of Silver Bow County, Montana.
15. Changes
We may update these terms. The date at the top shows when they last changed.
